Family of 12-Year-Old Shot by Transgender Mass Murderer in Tumbler Ridge Files Lawsuit Against OpenAI Over Failure to Alert Law Enforcement.

The family of a 12-year-old girl who survived the deadly school shooting in Tumbler Ridge has filed a lawsuit against OpenAI, the company that created ChatGPT, alleging the company failed to alert authorities after the attacker allegedly discussed violent plans with the chatbot months before the massacre.

The lawsuit was filed in the Supreme Court of British Columbia on behalf of 12-year-old Maya Gebala, who was critically injured in the February 10, 2026, shooting at Tumbler Ridge Secondary School. Her parents say the tragedy might have been prevented if warnings about the shooter had been reported to police.

Maya was inside the school library when the shooting began. As students rushed to take cover during the lockdown, she tried to lock the library door to protect other children from the gunman.

While attempting to secure the door, Maya was shot three times in the head and neck.

The attacker was identified as Jesse Van Rootselaar, who also went by Jesse Strang, an 18-year-old who authorities say had identified as transgender. Investigators say the shooter first killed members of the family at home before going to the school and opening fire.

Authorities say Van Rootselaar killed one teacher and five students at the school, all between the ages of 12 and 13. The attacker had also killed his mother and sibling earlier that day before traveling to the school.

Twenty-seven other people were injured in the attack, including Maya. After the rampage, Van Rootselaar later took his own life.

According to the lawsuit, the shooter had previously used ChatGPT to discuss violent scenarios involving firearms and mass-casualty attacks. The filing claims that OpenAI’s large language model safety and monitoring systems flagged some of the messages as potentially dangerous.

The lawsuit alleges that “approximately 12 employees” at OpenAI identified the posts as “indicating an imminent risk of serious harm to others” and recommended that law enforcement be notified.

However, the lawsuit claims that company leadership ultimately decided not to notify police.

OpenAI later alerted police after 18-year-old Jesse Van Rootselaar went on a killing spree and took his own life on Feb. 10. The company said the suspect’s ChatGPT account had been banned the previous June, but stated he was able to circumvent the restriction by using a second account.

The family argues that if authorities had been alerted earlier, the shooting might have been prevented.

Maya was airlifted to BC Children’s Hospital in Vancouver after the shooting. Doctors say she suffered catastrophic brain injuries, and her family says the wounds will likely leave her with permanent cognitive and physical disabilities.

Despite the devastating injuries, Maya survived the attack. Her family says she continues to fight through long-term medical treatment and rehabilitation while coping with the trauma of the event.

The family is seeking damages for the physical, emotional, and psychological harm caused by the attack.
